The National Prosecuting Authority (NPA) has confirmed Ajay Gupta's arrest warrant against him for corruption has been cancelled.

Ajay Gupta, one of the brothers who forms part of the infamous family at the centre of state capture allegations in South africa is no longer a fugitive from justice.

The National Prosecuting Authority (NPA) has confirmed his arrest warrant against him for corruption has been cancelled.

This means he can return to SA without fear of arrest.

Cabinet post offer for R600 million

Ajay Gupta and the son of former President Zuma – Duduzane Zuma – were at accused by Former deputy finance minister Mcebisi Jonas of offering him a R600m bribe and the position of finance minister before Nhlanhla Nene was removed.

On Thursday night, Hawks spokesperson Brigadier Hangwani Mulaudzi said the cancellation of the warrant for Gupta’s arrest was an inevitable legal consequence of the provisional withdrawal of charges against Zuma in January.

Jonas is scheduled to appear before the Zondo commission to close his testimony where he is set to face cross-examination from Zuma who was granted permission by the commission.

Commission chair deputy chief justice Raymond Zondo granted businessman Fana Hlongwane, who was also present during the alleged bribe, and Zuma to question Jonas based on the fact they are also willing to testify at the commission. 

The Guptas had applied to cross-examine Jonas however Zondo declined to grant permission as the brothers were not willing to come back to South Africa and appear in person at the state capture inquiry.

The NPA said that it was unable to continue with the case for now because Jonas’ evidence at the Zondo commission has not yet been finalised.

Gupta had maintained that he was not a fugitive in South Africa after the asset forfeiture unit, Sars and the police raided his family compound in Saxonwold last year.

At the time, his lawyer lashed out at the NPA, calling the prosecution body incompetent and its investigation a witch hunt.
